I. As if in the case of trial for murder.
... judicially take notice of the letter from Mr. Mercer to Mr. Ball and of the facts therein stated? Ought it not at least to have been authenticated by appearing in the Gazette!
I suppose murder is instanced as the gravest degree of crime, but the subject does not turn on degree. The Governor's appointment is not fairly stated as "the letter from Mr. Mercer." It should have been "the official letter from the Colonial Secretary," and "judicial notice not only might be, but ought to be, taken of that letter," as it is in perfect order, and worded in the precise terms of section 4 of Ordinance...
